Any pesticide product distributed or sold in the State of Delaware must be registered with the Pesticides Section of the Delaware Department of Agriculture (DDA). Application forms and directions for the registration of products are provided upon request and, in the case of renewals, are mailed to registrants on or about May 15th. The biennial fee for registering a product for sale and distribution is $70.00 for each brand or grade of pesticide to be registered. All registrations shall continue in effect until June 30th of the year in which they expire. Applications received between January 1st and June 30th shall be registered for the upcoming two(2) year period. Applications received between July 1st and December 31st will be registered for a two(2) year period beginning July 1st of the year in which the application was received. We provide on-line/electronic registration of products.

The Pesticides Section is also responsible for the submission of special local need registrations and emergency exemption registrations under the Federal, Insecticide, Fungicide and Rodenticide Act (FIFRA). Pursuant to authority under Section 24(c), of FIFRA, the DDA may grant registration for certain uses of a pesticide. One criteria for the granting of a 24(c) is that the pesticide active ingredient has a tolerance established for the specific food crop use. If a tolerance does not exist, and an emergency exists, the DDA may petition the United States Environmental Protection Agency (EPA) under Section 18 of FIFRA for a one(1) year exemption from registration. Section 18 registrations may be searched from the EPA or OPP website.

The Pesticides Section currently registers over 10,000 pesticide products. These products include insecticides, herbicides, fungicides, rodenticides, algicides, disinfectants, sterilants, repellants, plant regulators, dessicants, defoliants, or any substance intended to prevent, destroy, repel, or mitigate any pest.

There is no fee to register these products. A registration form with a copy of label and the name of the product on a separate sheet of paper is all we need.
